New DUI Laws

In the past year, California state legislature has passed new laws concerning DUIs and their sanctions. Overall, these new laws impose additional restrictions and additional penalties for those convicted of drunk driving. Some of the more important changes include:

  • In certain counties, including Los Angeles County, first time DUI offenders will now be required to install an ignition interlock device (IID) on any vehicle they own or drive. The IID installation, maintenance and review costs will be paid by the offender.
  • Repeat offenders who are on probation will now have a .01% blood alcohol concentration (BAC) limit.  
  • Anyone who is convicted of a third or subsequent DUI will have his or her license revoked for a period of 10 years. If the individual has not been convicted of any other drug or alcohol related crimes, 5 years from the date of his or her last DUI conviction, he or she may apply for a restricted license.
  • Individuals who are convicted of DUI reckless driving who have a prior DUI offense within the past 10 years will now be required to enroll in a certified DUI education and counseling program. Probation will be revoked if the individual does not register for, attend, or complete the program.
